J.M.C moved without notice and with the child. it took 8mos to find them, which law has been broken?

Myself being a JMC ans having exclusive possession to our other child, in Texas would this be considered abandonment or Extreme Child Disinterest? The child has spoken for a total of 23min with his mother since 9/11/10! Cam I claim/file emotional neglect?
